Child born in UK

Post by Laxman » Sat Oct 05, 2013 7:17 pm

Is there any right for a child born in the UK who was deported back home along with parents?

A child is under 10 now. What is the procedure if she wants to come back to UK? Can a child claim his/her rights when he/she becomes an adult?

Please advise.

Criminals are deported. I think you mean removed (perhaps involuntary, in the case of the parents). What rights are you referring to? Was the child British at birth? Children born in the UK are not automatically British if there parents are not settled residents, and given the removal of the parents with the child, one must assume that is the case.

Child may be entitled to register for British citizenship when child reaches 10.

Oops! Thanks.

Unfortunately, there are no entitlements, if the conditions are not satisfied.

The only way he will be able to register as british is if he/she turned 10 years shortly after you were removed, and you had been removed for less than 90 days before the child turned ten, or the child was removed having spent 10 years already in the UK , and tge child is of good character.

Or there may be an entitlement where a child is and always has been, stateless.

Unlikely to be stateless, as child was able to travel aboard?

You're no doubt right Vinny, I did think that but thought, just in case.
