BRP and EU Settlement Scheme for non-EU national

Post by millertron » Thu Oct 21, 2021 11:14 am

Hi,

I have ILR and have applied for a BRP, but my application was rejected for the following reason:

"The BRP(RC) application service is solely for use when replacing a lost/stolen or damaged BRP and is a like for like service. As you have status under the EU settlement Scheme, you have selected the incorrect option on the application form. You should instead apply for a replacement Biometric Residence Card (BRC) (issued under the EU Settlement Scheme)."

I am neither a EU national (I am Japanese) nor do I have any relatives who are EU nationals.
Is the above reason for rejecting my application still valid?

Are you married/partner of an EU national?

How (which route) and when did you get ILR?

What is the reason for applying for a BRP?

Hi, thanks for the replies.

As I mentioned, I'm not related to any EU national - I am married but with another Japanese.

I was granted my ILR in 1998, I'm not quite sure of the route but I moved into the UK with my parents back then who also didn't have any relatives who are EU national.

My reason for applying for a BRP is because my ILR vignette on my old passport is no longer a valid Right to Work document.

Seems like an error from UKVI as your settled status was issued without any relevance to the EU settlement scheme or maybe you incorrectly selected an option claiming that you had settled status under the EU settlement scheme. Where did you apply for your visa transfer to BRP ? You should have applied here: https://visas-immigration.service.gov.u ... nt-service

That's the exact link I used to apply for the BRP replacement.

I'm worried if I follow the advice on the letter and make an application including EU settlement scheme it would also be rejected because of 'invalid option'. It's most frustrating because the rejection isn't because of any problems with the documents (proof of residence) I provided!

Did you choose the 'Update, replace or transfer your biometric residence permit (BRP)' option to apply ??

I'm not quite sure how to check what I entered but I'm pretty sure that's what I selected.

I suggest applying again using that link. Also file a complaint with the UKVI https://www.gov.uk/government/organisat ... -procedure
