Regoarding ILR cancellation

hi to every on My situation is that I was student in uk over the Past 10 years and i applied ILR on the basis of long residency uk and i successfully got my ILR in september 2009. Although I had student visa valid untill january 2010 and I obtain my ILR in september 2009 and Last year of my ten years I didnot do very well with my course although my attandance was 95 % but I failed my course and unversity excluded me from the course because of poor progress and that was about 3 weeks before I applied ILR. Now college is saying that they going to tell home office about me that they have excluded me from the course. I am worried about new rules I am going on holiday and wondering if I will safe to come or will have some problem

It's possible ILR could be revoked if the allegations are true but why would the college be so vindictive or indeed be aware u'd applied for ILR - it's none of their business....

What allegation caollege can mede because I had 95 % attandance and I was waiting for result and my result was onlyconfirmed by end of agust and two weeks later I had appointment at PEO and I was didnot ask any question ILR was granted in 30 minutes. what is your source of information[/quote]

But why would the college wnat to revoke ILR and how do they know u have ILR?

Ughhh this is awful. I'm sorry you're going through this. How exactly did they find out that you got ILR?

question you ask how college has find out about that I have Indefinite Leave to Remain now I explain again

I came uk 5/10/1999
I complete 10 years legal stay 5/10/2009

When I last time extented student visa in November 2008 It was granted Until january 2010 which will cover my 10 years

My final course started from september 2008 and finish June 2009

and final date was 20/08/2009 when it was confimed by the university that I have been excluded from the course because poor results college shows that I have attanted college 95% this was my first time when I failed By the time It was confirmed by the college that I have been excluded from the course I already had appointment with home office at PEO and I was granted ILR With any question or they didnot ask any progress report attandance report from college eventhough I was legal.
college said to me that they donot have any problem with my ILR. They have to fill up their reporting duties. they have to tell home office that I donot study their any more. they said to me its ok your attandance is ok
and lots of people fail the course so what even the college would report the home office they would not curtail my FLR because it was left less then six months. They might not do any thing about it I am just worring any reply will be appreciated.
By the time college told me 14 january they will report to the UKBA but I havenot received any letter from UKBA.

According to your current status you are now considered as a settled person in UK. If your college or Uni. whatever you attended in past try to talk to you just tell them it is discrimination. They should deal with you as they would have dealt with a home student.

I am not a specialist but I know some of Universities and colleges do take the piss. Have a contact with a good solicitor not even a OISC adviser. And see what options have you got. Get ready to hit back.

I really don't think that your ILR will be canceled. The good think about 10yrs long residence is that all you have to prove to them that you have remained Legal in the UK for the 10years you are claiming what you were doing is not really a concern to them. Your University only needs to call home office if You are on a student Visa and you were excluded from their institution. As you are No longer on a student Permit but now ILR... You can sleep easy as you are FREE of IMMIGRATION RESTRICTION in the UK :D. You didnt Gain you ILR cos u were a student, you gained your ILR cos you spent 10 continuous Lawful Years in the UK. You just happened to be a student over that period.

I know people that applied 10yrs rule as follows:
7yrs student + 3 years Work permit - ILR Approved
9.5yrs student and 6 months Visitor - ILR Approved

This is why in the 10yrs Route all you need is Life in UK Test, Passport Photo, Passport to Cover the 10yrs and possibly Home office extension Letters and off course your application Fee... You don't even need to prove that you can afford to continue taking care of yourself, or if you live in a house or on the streets of Liverpool! :)

Dont worry yourself!! You haven't broken any laws. There are many people Home, EU and overseas students that Fail... Failing in school is not against the Law.
