Irish Nation w/Non-EU spouse, living in UK

Post by bdonegan » Sat Apr 26, 2008 11:11 pm

Hi,

I am an Irishman married to an Indian woman. I met my wife 2 years ago in university. Since then I have moved to London for work and she later joined me. We have been in London for one year now and got married last month (at the registry office). Now, we are having our reception in Donegal in August and we need to travel beforehand to make arrangements. The problem is that we are a little confused over what we need to do. As far as I can tell, we don't have any option other than applying for a C-Spouse multiple-entry Visa (100e) I'm hoping there is an easier (and maybe less expensive) way. Maybe somebody can shed some light?

Regards,
Brendan

I assume you just want to go to Ireland to visit, though in fact the law is even clearer if you want to move back to live and work.

You are working in the UK and so are exercising EU "treaty rights" here. Your wife can just apply for a simple visitors visa (ask for multiple entry for 90 days) on the basis of EU law. See http://eumovement.wordpress.com/2007/04 ... ional-law/

I would be very hardcore with the application, as otherwise they will jerk you around. Do not include a fee or any details of your work here. No bank statements. I would not include flight details or a reference in Ireland.

Do a cover letter that explains that you are exercising European treaty rights in the UK. Explain that any return to Ireland is covered by EU law, citing Singh, and that you therefore "expect that the application will be processed as soon as possible and on the basis of an accelerated process." Say that they should contact the Treaty Rights section of the DOJ on an urgent basis if they are unsure of the legal foundation of this application.

Have a good time in Ireland!

What about flying to Belfast and driving to Donegal?

Or Derry, for convenience. Carry your passports and marriage cert with you, that's all you need for a visit of up to 3 months.
