Update regarding EU court case and EU4FAM

Post by megmog » Tue Aug 19, 2008 1:14 pm

Hi all,

Just wanted to share some updates. Like many of you, my husband and I were denied a Stamp 4 last year on the basis of the ridiculous, and now defunct, "prior residence in an EU country required" rule. Instead, my hubby was issued with a Stamp 3.. which is due to expire in Sep this year.

Anyhow, we heard the news about the court case.. I know a few of you were wondering what happends now, for those already denied, are we under review? should we apply again?

Well, it appears the DoJ is under pressure to clean up their act.. we received a letter this morning by registered post from them, letting us know we are now entitled to our Stamp4EUFAM (how very kind of them!!!) and that they are back dating it to last year, as we were legally entitled to it then as well... it is valid for 5 years.

There was no apology for the fact my husband hasnt been working for the last 20 monhts (that, of course, would be too much to ask) but there you have it..

I expect those of you who have also been denied on this basis will get a letter soon too.
