Section 19 Citizenship revocation provision ruled unconstitutional

Post by Obie » Thu Oct 15, 2020 9:23 pm

The Supreme Court in the case of Damache, that section 19 is unconstitutional.

That the minister and her official cannot be the judge and jury in a matter of this sort, and that a matter as serious as revocation of citizenship, must be decided by an independent body.

It follows that Section 19 is ultra vires, and an amendment may need to be done to ensure it is constitutionally sound.
