General employment work permit rejected

Hi Folks,

My partner is a non eu person currently on stamp 1g. She got a job with HSE as a Grade 4 DIRECTORATE ADMINISTRATION SUPPORT at public hospital in Galway from July 2023, In August 2023 she applied for general work permit herself since her salary was 31000 Euro per year. In Jan 2024 her request for work permit was rejected with below reason.

It appears from the information received that the position on the offer is for an employment specified in regulation 29(1) and Schedule 4 of the Employment Permits Regulation 2017 (S.I. No. 95 of 2017) for which a General Employment Permit shall not be granted. Please note that the occupation in the question is on the List of Ineligible categories of Employment for Employment Permits. In line with section 12(3) of the employment permit cannot be issued.

My partner is now considering to appeal the decision by providing my documents from her bosses such as how this position is important for the Hospital and how they need her services, experiences and knowledge.
She is also thinking of hiring a lawyer to appeal the decision.

What are the chances of her securing the work permit ?

For me it look like going to be waste of time and money since the reason mentioned above is very clear that her job is not eligible for work permit. I tried to tell her to look for other opportunities which allow her to apply for work permits based eligible job list. Since she have 1.5 years left on stamp 1g and don't want her to waste it by re appealing.

Checking through https://onsdigital.github.io/dp-classif ... _tool.html just by the job title and it gives 4151/4159 (most likely 4159 fits more), which are both ineligible.

Is she a graduate or dependent on you? Are you planning to split up?
1G is even more beneficial compared to stamp 1, as it gives more flexibility with regard to jobs.

I told her the same thing. The framework setup by DJE is there for a reason if her job is not in eligible list they won't budge. But her manager and HR told her they will provide letter of references. TBH I dont think its going to work. She also spoke to some lawyer who is going to charge her 500 Euro for appeal and he told her should not worry and she will get the work permit.

She graduated from her last year. I told her to continue with her current HSE job and keeping looking for other where company is ready to sponsor or help to self sponsor.

Also does anyone know what happens in appeal process ? My understanding from reading online is DJE will request more details/documents from HSE but her lawyer told her they won't.

So if someone has idea on how appeal process work can they share the light on it ?
