I am from the UK and have been living in Ireland since 2001. I have a 13 year old son from a previous relationship and have shared custody. He was born on Ireland. My current partner is 12 weeks pregnant, from the USA and here in Ireland as part of the visa waiver program for tourist. She has been here for 70 days.
I do not meet the requirements to sponsor her on a D visa and I am wondering if she stays in Ireland and gives birth to our baby, would she be in a position to stay in Ireland through ascend?
I can't move to the USA as my son lives here and we are worried that if she leaves she may not be let back in.

*If either of your parents was an Irish or UK citizen at the time of your birth, you are automatically an Irish citizen if you were born in Ireland. If you were born in Northern Ireland to an Irish or British parent, you can choose to be an Irish citizen
(For your American partner)
******If you do not hold a valid immigration permission or if you are on a short stay ‘C’ visa, you must complete the parent of Irish citizen child application form and submit it, with all the required documentation.

Your current Irish Residence Permit (IRP) or GNIB card
Your child’s Irish passport
Your child’s birth certificate
Documentary evidence of your address in Ireland (for example, utility bills)
Documentary evidence of your child’s address in the State (a doctor’s letter or school letter)
