eu1 application and pregnancy

Post by daddy » Thu Oct 14, 2010 7:15 pm

My wife(eu citizen) is excersing her treaty right as a student. I am on temporary stamp4, pending my eu1 application . my 6 months stamp4 will expire end of febuary 2011, presently, my wife is pregnant and will deliver in febuary 2011

My question is, if my my wife is unable to attend school during the last 2 months or less before delivery due to pregnancy illness, would DOJ refuse my eu1 application as a result of that. Does anyone have a sugestion for me please.

Thanks.

As far as I know, once you are working and there is an income in the family, your wife can be classed as self-sufficient, another way to exercise treaty rights. Also as far as I know, pregnancy and maternity leave will not affect your residency application.

Perhaps someone else can answer this for you also.

if she was in full time work, she would be fully entitled to maternity leave. I can't see how it will effect her.

I strongly believe that if you run your wife's maternity condition with the college, and their is a common understanding. Then she will not be listed as withdrawn from the course, but rather as of for maternity related reasons. She will still be considered as exercising treaty rights, and the justice department will not be unreasonable enough to consider her as unqualified. Alternatively you could get a sickness insurance, and make sure you can show adequate resources in your account

insurance

Thanks Obie for your concern, you have been so helpful to me and many others in this forum, God bless you and family.

We do have medical insurance and we submited a letter from our medical insurance company when I applied for my residence card in August.

We have a bank statement which shows regular deposites and withdrawals but our balance is always less than two thousand, sometimes less than one thousand. We do not claim any form of benefit.
Thanks.

my eu1 was approved months ago, on completion of 6 months of lodging in my application, goodluck. I also forwarded to INIS a letter from my wife's doctor stating when she would be due for delivery. M daughter is 4 months old now. Make sure your family have medical insurance cover, if eu spouse is a student or selfsufficient, very important!

Goodluck daddy.hope your daughter and wife are in sound health. Just wondering one thing when did you let them know that your wife is pregnant. As I did not mention it in my application cause she has her academic break of one month before our baby due. The temporary term of six months also due on that week. Doj is obliged to give a decission by six months which is due on 3rd of november and my wife's due is 28th of October. Any expertise opinion will be appreciatable.
