Query about reckonable residence calculator in Irish naturalization

Post by sing88 » Fri Dec 24, 2021 11:32 pm

Hi,

Happy xmas and New year to all....

I have been in Ireland since 2016 Jul. I am eligible for applying naturalization but i have a queries in the residence calculator.

I was out of Ireland more than 6 weeks on 2019. 20+ 20 days( 2 trips) in india for personal visit, 4+2+2(3 trips) in Europe tour.

Please find the below residence calculator based on each and every stamping have done by immigration officer during the travel time and got the below message,

stamp1 stamp2 days in ireland stamp
6/7/2016 4/11/2016 121 stamp1
20/11/2016 24/6/2017 216 stamp1
17/7/2017 24/1/2018 191 stamp1
28/1/2018 9/12/2018 315 stamp4
20/1/2019 17/5/2019 117 stamp4
20/5/2019 2/8/2019 74 stamp4
6/8/2019 2/11/2019 88 stamp4
4/11/2019 8/12/2019 34 stamp4
19/1/2020 17/3/2021 423 stamp4
4/4/2021 24/12/2021 264 stamp4
total 1843

message after clicked calculate:

1. red ticket -> Year prior to application not continuous
Based on the information entered there has been a break in your permissions in the year prior to the date of application and you have 265 days continuous reckonable residence immediately prior to the date of application you entered.

2. green tick -> Has 5 Years Residency

You should ensure that your registration with the Garda National Immigration Bureau is kept up to date during your residency in the State and that your permission stamp(s) cover the year prior to application without any break.

I am getting the message like " red ticket as year prior to the application is not continuous but i was out of ireland only for 2 and half weeks" and got a green tick as I stayed more than 5 years residency.

Message from citizen information website:

Residence in the State:

You must have lived in the State for a certain length of time. The specific requirements are that you:

Have a period of 365 days* (1 year) continuous reckonable residence in the State immediately before the date of your application for naturalisation and
During the 8 years before that, have had a total reckonable residence in the State of 1,460 days* (4 years)
You can leave Ireland for up to 6 weeks (in total) per year and still be considered resident in that year. If you leave for more than 6 weeks in one year, you should not count this period when you are calculating your reckonable residence. If you had to leave Ireland for longer than 6 weeks because of an emergency, you should explain this in your application.

If you spend more than 6 weeks outside of Ireland in the year immediately before your application, you may have to wait until the following year to make an application.

Please clarify the below queries according to the above message from citizens information websites,

1. am i eligible to apply naturalization as i was out of Ireland more than 6 weeks due to personal visit to india?. I can provide the letter why I was there for long time?.

2. why I am getting red tick as I was out of Ireland only 2 and half weeks in 2021?. did I make any mistakes in the residence calculator?.

If you are away for more than 42 days in any year, you need to deduct the entirety of these days that you were away.

So if you are away for 50 days, you need to wait for an extra 50 days after you reach your 5 year residency point.

Regarding the red tick, as the message said, you left a gap in your residence calculator between 2020 and 2021, probably because the government was locked down at the time and your permission was not renewed until later. In such cases, you need to extend the expiry date of your previous permission to be right before your renewal date.

Hi,

i also have a question if i may ask please?

I am collecting proofs of residence for each year of residence claimed and my question is;
1) for every year of residence claimed, the 3 different proofs of address should be on the SAME address?
Can it be different addresses per year? Like 2 proofs on one address and the 3rd one on a different address?

Kindly help?

Many Thanks,

- I have already deducted this days and stayed more than 1830 days as per residency checker. So I am eligible for naturalization correct?. sorry to ask same question for better understanding.

- I have 2 years stamp 4 till 28th Feb 2022 and travelled only for 2 weeks in march 2021. So here I can update expiry date as 30th April 2022 and get a green tick in the residency calculator. is it the one you are trying to say?.

As you are not fulfilling the continuous residency in the last year, you can apply only on 4th April 2022, when you can achieve full 365 days after returning from India
