Stamp 1G and Maternity leave payment

Post by lovebino » Mon May 02, 2022 12:45 am

Hi Folks,
I was just wondering, can a female employee receive maternity leave payment if she is working under a Stamp 1G as a spouse of a Critical Skill Worker Permit holder and has enough PRSI contribution?

By law, all female employees in Ireland who have enough PRSI contribution can get this payment but it seems it violates the conditions of Stamp 1G.
Anyone have any idea?

PRSI contributions are personal contributions, so yes they can use them of course. They are not means-tested benefits.

Claiming maternity benefits will not affect your visa.

As indicated, it is not means tested, and it will be discriminatory on grounds of gender if you were prohibited from claiming it, as such conditions will likely affect female workers than male workers.
