By the Grace of Almighty Allah got my Approval Letter today

Alhamdulillah long wait of over 15 months of battle finish today finally and i received my approval letter and passport today.

BRP to follow.

A brief timeline:

Applied : january 2013
Interview attended: june 2013
Refused by blind case worker who cannot read docs: june 2013
Appealed againts the decision: june 2013
Hearing took place: january 2014
Determination rceived:12 feburary 2014

Since then calling HO and chasing up every single day and finally received my passport and approval letter............. Thank you to immigration board and members who helped me with good and bad time during last 15 months of torture ......... I am more than happy to answer any question and will be available to help anyone i can.

I was reading your other posts you did well mate , how did you win it what HO said they made a mistake in decision or they couldn't read or interpreted what you have said in the the interview.

I have a quick question when you will go for ILR will it be based on long residence or Tier 1 ILR, as for ILR the requirement is this :

This page tells caseworkers about the indefinite leave to remain (settlement) requirements for the Tier 1 (Entrepreneur) category
of the points-based system.

Requirements for indefinite leave to remain

You must grant indefinite leave to remain if the following criteria are met:

The applicant meets all the requirements of paragraph 245D or 245DF of the Immigration Rules.
None of the general grounds for refusal in paragraphs 320 to 324 of the Immigration Rules apply (for more information, see related link).
 The applicant must not be an illegal entrant.
 They must score 75 points for attributes (see table below)
They must have enough knowledge of the English language and enough knowledge about life in the UK, with reference to
appendix KoLL of the Immigration Rules,unless the applicant is under the age of 18 or aged 65 or over at the time the
application is made.
The applicant must not be in breach of immigration laws, except for any period of overstaying:
o for 28 days or less which will be disregarded, or
o where the application was submitted before 9 July 2012.

I had the option to withdraw and apply ilr while waiting for hearing date but i didnt bc of 2 reason one it was team application and my team member is my ypunger brother and secondly thy refused me for silly reason so i thought lets fight and win this not just for me but for my brother n team member so thx to Almighty finally happy ending after all the hassle, time n money wasting exercise.

Thx sindhoo ..... My application was refused on genuinety but i appeal and proved it wrong to them that case worker was dumb enough to not read the documents and called for interview bcz thy couldnt open my company website bcz they typed the wrong website address and that information was found in SAR report case notes of tier 1 application refusal ....... But unfortunately i received this information after my hearing date anyway i had very good judge and we had massive arguments and both of us was cross questions at length and finally we got determination in our favour and it was 23 pages of determination and Judge has grinded case worker properly in it and allowed our appeal.


Regarding ILR i will be applying under 10 years long residency as i have completed 10 years back in August 2013 but have been waiting since then as my tier. 1 appeal was pending.

Since waiting for my Biomatric Card, ask my lawyer they said you have to wait 2-4 months.

Congratulations Rehan. Al last by the grace of the Almighty Allah your hard has paid of. I have been following your update for long time.
I am facing the similar problem. My timeline is almost identical like yours.
Apply-11/01/2013, Interview-10/06/2013,Refusal-20/09/2013, Appeal-05/10/2013,Hearing-16/05/2013
The refusal reason is almost like yours for both of the team member paragaraph 245 dd(i) not genuine.....We have the money available for investment from 10th January 2013 till now above 50000.Both of us are ACCA affiliate while I will be applying for my ACCA membership in few weeks, set up business and accountancy services company, my team partner qualified in Feb 2014. The refusal reasons---
1. You registered your business 4 days before application..didn't use your PSW to build the business
2. No market research......3. Credibility of funds..as transfer details were not submitted... we explained in interview that it was our savings from last 8 years, we can over 15 thousands income for both us for last 2 years on PSW and reasonable income while we were studying. 4.No proof of experience in CA firm. though I was not asked for to provide, working in a CA firm for 2 years, 5. No tax paid though I explained that tax return deadline is 31/01/2014 and submitted my tax return for self employment and up to date with tax payment... Will really appreciate your help and suggestion from members..Thank you all.

As long as ur business is trading and if u can prove this in front of judge by proividing business bank statement than its very easy to convince the judge regarding funds its better if u can show the source of funds as it will clear the air but if there is something like u put cash in ur account then u need to backup that wit some solid answer but again as long as u have access to funds since u made the application than u have good chances as u can say u have the pocession of funds since u made the initial application so if funds wasnt urs then they wont be sitting in ur account since october.

There was no such a requirements to show prvious experience and during the course of psw either but since the changes in january 2013 they r asking for it so u need to cover this up someone how.

Regarding registration of business u can say u been searching for it from number of months and when u thought its right time u registered the company and again there is no such a rule but instead u u have to be a director of company not more than 3 months old.

Hope this is off some help and feel free if u want to ask anything i m more thn happy to discuss anything regarding refusal.

Thx dancingguy05, i doubt calling them make any difference as those people over the phone r just telephonist and thy jist tell u wht is on the system...... I called on the 8 and i been tols keep waiting as ur application is undecided and yesterday whn i recived my approval letter its is dated 8th april and same date on the bio metric cards

So it clearly shows they dont have any access to case working or any other dept and thy just simple tell u wht is on there system.
