Gurus I need your help regarding appeal withdrawn by HO

Post by tanvir1985th » Fri May 02, 2014 8:12 pm

my situation as follows:

fresh application after exhausting appeal right in december 2013

refused with another appeal right( by mistake obviously)

Appeal lodged and registered by tribunal

decision withdrawn by home office today

My question, can case worker refuse the application again without appeal right this time?
please gurus help me.

thx rehan. I dont think this withdrawal is something positive. rather i think the POU realised there should not have been any appeal right. so they played this trick. but dont u think by law they have to give an appeal right as it was in appeal before(though by mistake)

I never come across something like this in past, so I guess only time can tell or wait for some more replies from seniors.

by the way what was your refusal point?

@ tanvir1985th, granting you an appeal is not a big issue because if they didn't grant you the appeal right, you still have the option of JR which is exactly the same as an appeal right with the exception of not having any right to work due to not having section 3C.

In my opinion, Home Office are very likely to grant your visa as they might have realise that they have no strong case in denying your second application.

Lastly, don't be scared if they withdraw appeal as you still have the statutory right to a JR.
The key to success is knowledge and hardwork, and to have faith.
