Company formation for Tier2->Tier1-Ent

Hello,

I am on a Tier-2 General Visa at the moment and planning to start a company here in the UK/EU.
Does anyone know if its possible to form a company before I file for Tier 1 Ent Visa ? Or would it be better for me to do it through my spouse who is on a Tier-2 dependent visa.
It seems that I should be able to form it and even work in it for 20 hours/week
