can i apply for a fresh application as my entrepreneur visa application has been refused and admin review also has been refused as i forgot to provide them business account's bank statement. so please advise me if i can apply for a fresh application ?

Hi

That's the only option left as far as I understand. JR might not be positive either and can make you overstayer.

Kindly do check Rule 3c before applying.

I am no expert and have no idea about JR, but I remember there was one thread on this website where the person applied again after AR refused and he got his visa.

Just wanted to share my good news with the members, my solicitor received BRP yesterday with an extension of further 2 years. BRP states the extension from 14/12 for nest 2 years, so don't know what will happen when I apply for my ILR in about 15 months time, as technically have been an over-stayer since July 2015, but for now I am very relieved. Thanks very much for all the members for their contribution and all the best who are awaiting the outcome of their application. My timelines are as follows

T1 Visa Expired : 25th June 2015

T1 Extension application submitted: 17th July 2015 (with in 28 days of expiry of Visa)

T1 Extension Refused: 29th August 2015

Administrative Review Refused, enforcement letter issued: 29th Sep 2015

Fresh Application Submitted : 18th Oct 2015

BRP Received: 17th Dec 2015

One issue though is that you received your AR on 04/02, i.e. 4th February. It is already 5th March, so over a month. I think one becomes an overstayer two business days after the AR is processed, so I believe that date is 5th/6th February for you (since the AR was processed on 3rd February)?
Obviously you cannot apply tomorrow but you must send in your application on Monday if the documents are ready.

I think one has to apply within 28 days of becoming an overstayer. I think HO starts considering the applicant an overstayer after two working days from the day on which the AR decision is made. Perhaps senior member could confirm.
Have you taken any action in the past month since you received the AR decision?

Was there any reason that you could not apply within 28 days of receiving the AR decision?

I don't have detailed knowledge about AR and JR, but I think the application should have been sent by now as I believe 28 days have already passed, so you will have to tell them what it was that stopped you from applying within 28 days of overstaying. If you apply on 7th, make sure you have a very good reason about why you did not do so earlier, because you need to have some solid reason.

Do you have a solicitor who can guide you asap if you apply on Monday?

Oh right. In that case, don't apply in a hurry, unless you have already prepared your file and it is ready to be sent to HO. It would be good if you can apply on Monday, but if you are not fully prepared, then maybe take one week to make sure every document has been included and nothing is left out, and maybe apply at the end of next week, in my opinion. Double check with the guidance to ensure you have everything in your file.

Yes, I saw your posts. That is why I suggested in my previous post that since you are within the 28 days limit, as you only received the decision on the 4th of March, you should still apply asap, but ensure that your documents are all ready and double-check with the guidance.

Here is my timeline:
entrepreneur visa expired on 04/04/16
extension application submitted 25/03/16
interview 19/07/16
refusal 19/09/16
AR 07/10/16
AR refusal 04/11/16

The reason for refusal was that the investment money transaction was not identifiable for HO and two other reasons was lack of 2 documents that HO withdrawn those two after AR because the docs were submitted and it were in our bundle.

I am in process of submitting a fresh application.
Someone told me I can do the JR and Fresh application at the same time. could someone please advise if that is true and if these two could be done at the same time??
