Visitors visa after Tier 1 Entrepreneur visa expires?

Post by ChangeM » Thu Jan 03, 2019 3:35 pm

Hi - I am currently in the UK on a Tier 1 Entrepreneur visa, which is expiring at the end of 2019. Unfortunately the business opportunity has not gone as planned, and I will be unlikely to be able to extend under this visa category as the business has not scaled as we had hoped.

My children and grandchildren are settled in the UK. Once I leave will there be any restriction or negative impact on applying for a general tourist/visitors visa in the future? I hope to still come and visit my family members remaining in the UK. I am meeting with my immigration advisor soon, but looking for any available information or guidance in the interim.

Many thanks

Sorry to hear about that. It unfortunately happens in business.

Have you already made the investment and hired any employees at all ? You still have about a year if you are looking at alternative business opportunities.

To answer your specific question - as long as you leave on your own before the expiry of your current visa and you have not violated the terms of the visa (for example, by working for other companies), the non renewal of the visa on its own is not a negative in any manner for future visa applications.

Thanks marcnath for the quick reply, that is reassuring to know. I am still looking into alt. opportunities, but want to plan for all eventualities.

You mention adhering to terms of the visa - for future visa applications, would the HO request any specific details or documents regarding this period of time to evidence that I complied with the T1 visa requirements while I was here? (i.e. that I have been self-employed and trying to grow my own business)

Many thanks

You can't really produce evidence to show that you complied. Most visa applications require you to declare that you complied. And if HO finds evidence to the contrary then it would be evidence of fraud, which would result in a long ban.
