Tier 1 Entrepreneur ILR 5 years

Dear Fellow Members,

Can you please advise, when is the earliest I can apply for ILR on 5 years route. I was first granted the tier 1 entrepreneur visa in Jan 2012. first extension was granted in April 2015 until 27/04/2017.

My question is, when can i apply for ILR ? In Jan 2017 (5 years from the date of first visa) or in April 2017 when current visa is expiring?

I would be grateful if you can please include the web link for home office website to confirm the answer.

The qualifying period for ILR is 5 years minus 28 days (almost 4 years and 11 months) if you had no period of overstaying. This means that if you were granted initial visa in Jan 2012, you can potentially apply in December 2016 (obviously when you meet ALL criteria for ILR)

Thanks for your kind reply. I have checked the link, but i couldn't find anything to say that 5 years from the day for first application approved.

I know you are right that I can apply in Jan 2017, But i was hoping if you can be very kind to direct me to the page number of that document where it says about 5 years from the first day of approved visa.

Page 19, Calculating the specified continuous period
The example shows how the 5 year is calculated backwards from the date of ILR application which implies that during that 5 years if you have the visa you are qualified. So for example you can be on a Tier 1E visa for 5.5 years but only the FINAL 5 years matter as they count it backwards. :)
