Change of Route

Post by kim001 » Mon Mar 19, 2018 11:18 am

Hello respected members of this great forum,
I am currently holding a T1 Entrepreneur visa. I have how ever applied for extension 9 months ago.

Question 1. After my successful extension, could I possible change my visa route to Tier 4 student dependant?(i.e if my wife goes back to our country to apply for a student visa and she returns)

Question 2. If the answer to question is yes, does it have any effect on me if i want to apply for ILR through the 10years long stay route as I would have been a principle applicant for about 8.5yrs and a dependent for 1.5yrs?

Thank you for your help.

1. Yes, provided she is studying a course that permits dependents.

2. No.

Just pointing out that you can apply for ILR as T1e in 1year and 3 months (or less depending on when you applied for extension at 3 years or 3year and 4 months)

Sorry to comment. Just to add some information i got from a solicitor told me that switching to dependent will break 10yrs continuity for propective tier 4 dependent (in case of tier 1 ent main applicant i.e. husband)

I m not sure further whether he meant for in-country main applicant getting tier 4 student visa (wife) and then tier 1 ent goes to dependent in-country
OR
tier 4 wife getting visa from outside country and then tier 1 ent switch here.

Moderators and seniors are requested to shed light more on it.

Thanks

The 'solicitor' is wrong. ALL visas count for long residence provided there is no absence of 180 days or more and if a visa is applied outside the UK in the 10 year period, that the applicant left the UK with a valid visa and applied and returned within 180 days.

I was not tagging a question in someone post. As it does not relate to my scenario now at all.

But I was just adding some information as input which i had in past from solicitor and thought it may be beneficial for him to be discussed further.

Anyways. Solicitor means did not know much info.
