Tier 1 PSW to Tier 1 (General) - Dependant

Tier 1 PSW to Tier 1 (General) - Dependant

I am a Tier 1 PSW holder (valid till Dec 2011). My wife holds a Tier 1 (General) visa valid till Jan 2012. We both are working at London.

1) I would like to apply for Tier 1 (General) - Dependant. Can I do that from UK, or should I be going back to the place of origin to switch from Tier 1 PSW to Tier 1 (General) Dependant? (Provided we both are currently in the UK)



Adding a bit more fun into this

Recently we were blessed with a baby boy in India. My wife and kid are in India.

2) When my wife is in India (Tier 1 - General primary applicant), can I apply for Tier 1 (General) Dependant from the UK?

3) Can I make a visit to India and apply for a Tier 1 (General) Dependant from India (when my wife is in India)

4) After obtaining a Tier 1 General Dependant visa from India, can I enter the UK without my spouse (primary applicant). Or should the Tier 1 primary applicant be already present in the UK or travel along with the dependant (when the dependant enters UK the first time with Tier 1 (General) Dependant visa). My wife and kid are planning to come only after 3 months, so was wondering if I could go to India and get my visa sorted and come back alone.

1. Entry clearance from outside the UK.
2. As above.
3. Without the visit to India, you cannot fulfil 1 or 2 above. When you do it is up to you.
4. Shouldn't be a problem as your spouse is absent from UK on a holiday. It is not that she is yet to enter (and start living) in the UK. If IO has any questions for you, answer them honestly and explain your situation.
