Tier 1 (Post-Study Work)

Hi

Please can you help.

My girlfriend is currently in UK as a dependent on her mum’s ancestry visa. She now has a job and doesn’t live at home so is no longer dependent. She is considering applying for the Tier 1 (Post-Study Work) category.

She has a degree from Bristol University awarded within the 12 months. She meets the points under the assessment.

As she is no longer a student, does she qualify to switch in to Tier 1? i.e. does she need to be a student at the time she applies?

The policy guidance also states “dependants that are in the UK may apply under Tier 1 (post study work) but they are unable to switch into becoming the main applicant for this categoryâ€

She (or you, as it was till some time ago) may apply for Tier 1 (PSW) ..... but will require an entry clearance from outside the UK (i.e.- cannot apply from within the UK).
