Surrinder Singh and claiming benefits

Hello,

I wanted to ask some questions about claiming benefits before I actually did it.

I am a non-eea national, married to a British citzen with two britsh children. We have just recently entrered the country on a EEA FP.

I have already applied for my EEA2.

My question is are we okay to claim benefits? Or will it affect my application for an EEA2?

What type of benefits are we eligible for? I am actively looking for work, so I hope that I would only need to take out housing benefit and nothing else.

Is it possible?

Since April of this year restrictions have been introduced on EEA entrants claiming housing benefit. Your sponsor (wife) will have to show that she is earning at least £149 a week for three months before you can access a range of benefits.

On the basis of Eind, it is possible those restrictions cannot be applied to British Citizens who are returning from another memberstate having worker or was self-employed there.

Those categories of people retain their work status, and hence will be entitled to access these benefits as if they were worker in the UK.

Probably it may be best for the wife who is a British Citizen to claim it than the non-EEA.
