Eligibility for Discretionary Housing Allowance question

Where one spouse holds ILR and the other has a postal application for ILR pending, and the ILR holder is recieiving Council Tax and Housing Benefit, can he/she apply for DHA (Discretionary Housing Allowance) if they are having difficulities meetig their costs?
