Hi,
I recently got ILR on April 14th 09 and i made a claim for tax credit.On 13th of may i received £110.86 , £49.58 and £10.86 in my bank Account from tax credit department.


When i called them to find out about all thoes payments they told me that £110.86 is for last year tax credit and £49.58 is from this year tax credit and £10.86 is for that particular week.and from next week u will get £10.86 every week.

My question is that i got ILR on 14th of April and i am entitled for tax credit from that date so why they are also giving me tax credit for last year as well.Is that okie or that will create any problem in my Naturalization application next year.

Please advice me .

It is possible, on your facts, that you might have been entitled to claim Tax Credits prior to you getting the ILR, so they have backdated the maximum 3 months.

In order to check this out, please post :-

• prior to your ILR, what sort of visa did you have?
• your nationality?
• your spouse's or partner's nationality?
• prior to coming to the UK, did you work in any other country, apart from that of your nationality? If yes, details please.

What about Child Benefit, have you recently started to claim that?

Also, about the Tax Credits, assuming you have a spouse or partner, please confirm that the Tax Credits claim is in joint names of the two of you.

Hi prior to my ILR we were on HSMP Visa.

Me and my spouse both have indian nationality.None of us worked in any other countries except India and UK.

OK, thanks for that information.

That being the case, there was no entitlement to Tax Credits prior to the ILRs being granted. These days, on the Tax Credits application form, there is a question about whether you have been subject to immigration control in the last 3 months, and if so the date you stopped being subject to immigration control. Assuming that question was completed accurately, it is clear that HMRC have made an error in paying you for the period prior to the grant of the ILRs.

I suggest you phone the HMRC, telephone number on the documentation you have received from them, and point out that you and your spouse only ceased to be subject to immigration control on 14.04.09.

Child Benefit being claimed? Have they backdated that prior to 14.04.09?

Ya , i also aplied for child benifit on my name but haven't receive anything yet.

I called child benifit number yesterday and they told me that it will take up to 8 weeks to process the claim.So , i am waiting for reply.

Shoud i repay the amount which i recived by error for tax credit or it will be okie.Will it create any proble for our citizenship application or not?

I don't think it will cause a problem with subsequent Naturalisation applications, but I would still point out to HMRC that they have made an error.
