CTC and WTC

Dear All

We arrived in the UK in the latter part of 2007 from India. After my son was born I was informed by some of my friends that I could apply for CTC and WTC. However, before we applied for these, I cheked with HMRC over the phone . I explained my situation to them that I was working under work permit and my wife is dependent. They said I was eligible and started paying me. Recently I discovered that I was not ligible and immediately asked the HMRC to stop the payments and also informed them in writing. They acknowledged that there was a mistake but I did not receive anything in writing from them

Now I am really worried that this will affect my immigration status. Can you please advise me on this matter.

There is nothing to worry about, for two reasons. Firstly the form to be completed to obtain ILR asks about benefit in the present tense ..... "are you claiming" ... and of course the only honest answer to that question is "no".

Secondly, UKBA have acknowledged that where benefits are paid by HMRC inadvertently, there is not a problem. You contacted HMRC and stopped the benefits, which was exactly the right thing to do.

assam, OK you are from India, but before coming to the UK, did you or your spouse ever work legally in any other country, apart of course from India? If yes, details please, which country?
