Tier1(G) dependent and pregnancy

Post by tcpip_helper » Sun Jun 20, 2010 11:53 am

hello all,

I am on T1 (g) visa and my wife is here with me as my dependent, she is around 27 weeks pregnant and thus eligible for pregnancy grant of £195.

my question is as a T1(g) migrant can we avail this grant or is it the use of public funds which will obviously cause me problems when i'll be in need of extension of my visa

thanks for your replies.

Tier 1 (G) migrant who has no recourse to public funds cannot claim Health in Pregnancy grant.

Who can get the grant?
You can get the grant if all of the following apply:
you are at least 25 weeks pregnant
you have been given health advice from a midwife or doctor to help you and your unborn baby stay healthy during pregnancy
you are present, 'ordinarily resident' and have a 'right to reside' in the UK ('ordinarily resident' will depend on your circumstances but it usually means your main home is here)
If you're a new arrival to the UK, the residency rules are the same as for a Child Benefit claim.

and one of the residency rules for child benefit claim is as follows

If you're subject to 'immigration control'
You may not be able to get Child Benefit if you're subject to 'immigration control'. Immigration control means either:
the Home Office says you have permission to stay in the UK (known as ‘leave to enter or remain’) but this permission is given to you on the grounds that you don’t claim some benefits, tax credits or housing help paid by the UK government (known as ‘recourse to public funds’)
you need permission to stay in the UK – again known as ‘leave to enter or remain’ - but you don't have it
Sometimes if you’re subject to immigration control you might still be able to claim Child Benefit, for example if you're from a country with which the UK has a social security agreement that covers Child Benefit.

Why did you think she is eligible for pregnancy grant?
