hi

thanks for reading as im sure this topic has been done to death but i cant actually find the exact anwers i need.

my hubby is non eea, im a british citizen, we have just got family permit back into uk, using surinder singh route.

i want to ask about benefits, we are hoping to go to the uk to live, what i want to know is during the first few months are we able to claim benefits such as job seekers allowance or housing/council tax benefit?

we will be job-hunting and also trying to look at setting up a small business but this will take a couple of months so are we able to claim benefits to start or are we not entitled?

also after we have got work/set up business then he would be applying for the residence card, would the fact we had claimed benefits when first arriving affect this application?

please help as having come so far i dont wnat to get anything wrong!

You can claim these benefits but you may fail the ''Habitual residence test''

hi

thanks. i dont think the habitual residence test would be a problem as;
i have close links with uk as all my family there including my daughter
i was in the republic of ireland when not in uk
was only out of uk for 6 months
am settling their not just visting

would any of those benifits affect an application for a residence card? of course by the time we apply for the residnce card we would both be working or self employed so would only be getting any top benefits?

your advice is appreciated

Please explain more about this Habitual Resident Test. I am also a returning British Citizen. I need to know also if I and my spouse (Non Eu) can apply for a Job Seeker Allowance?
I will really appreciate any quick reply.
