applying for ILR

Post by jen27 » Fri Aug 05, 2011 10:34 pm

hi there, i wonder if i could get help here with completing my application for ILR. I am on spouse visa at the moment my husband is British n we have a little daughter. i am a bit confused which box to tick into section 7 about benefits . My husband was claiming child benefit in his name only, Child Tax Credit in joint names, JSA at a single rate as his work has stopped recently n help with the rent housing benefit in his name only for him n our baby who was born in UK. does anybody know what box to tick in this case as im a bit confused about what i was reading on here.shall i tick it all that been named in my partners ?and if he was receiving a working tax credit when he was working but not anymore as his work stopped. shall i mention this on the application?

This may help from the beginning of the pinned thread on Claiming Benefits posted by John in 2008, the forum Moderator who is our expert on Public Funds.

"The question of the application form relates to "Public Funds" but because of the way rule 6B of the Immigration Rules is worded, in the circumstances dealt with here, neither CB or TCs are within the definition of "Public Funds".

So you are fine to tick only the box showing your husband is claiming. Has your husband confirmed that he isn't able to include your child in his JSA claim?

Your husband doesn't need to mention that he was previously claiming WTC as the question asks what Public Funds are currently being claimed.
