Hi all

Apologies if this has been stated somewhere already.

My wife is just sorting out all her paper work for her ILR and just noticed that claiming child benefit is recourse to public funds and is worried this will see her application denied.

A bit about our situation. My wife is on a two year spousal Visa which expires in February 2012. We have a 4 month old baby together (who was born in the UK). My wife is American and I am a British citizen. We applied for child benefit, but we stupidly done it in my wife's name rather than mine! Basically, my question is, is my wife in breach of her spousal visa (no recourse to public funds).

If so is there a way we can rectify this situation (IE Pay the money back)? It was a genuine error on our part, if indeed this is an error as I understand there is exceptions to the rule.

You need to request to have it changed into your name before you wife applies for ILR.
