Post by wayeda » Thu Jan 12, 2012 11:46 am

Hi, i'm the sponsor of my partner, im British born, im self employed and currently facing a few hardships, me and my partner are both living together in a council owned property, im trying to apply for housing benefit and council tax benefit,
she has a no recourse to public funds on her passport, she came into the uk in september 2010,
she is from Pakistan and will be applying for indefinete leave as her visa expires soon,
if i claim housing and council tax benefit will this affect her status? also im claiming not her.
She is here on a spouse visa.

with sincere respect Greenie, iv tried studying the sticky topics but don't seem to see a clear answer, the only thing i can gather is that i can claim as the sole claimant but the benefit advisor this morning iv seen said, we need to have your partners details? then made me sign a document that said it MAY risk my partners residence status.

yes - you claim as a single claimant in that you can only claim the amount that a single person in your position would be able to claim. However, you need to declare your partner's details and income/savings as she is part of your household. This has been answered countless times, I know this because I have given the answer.
