Tier 2 Dependent - SSM Grant and baby citizenship

Post by zeeshan8800 » Tue May 15, 2018 2:16 pm

Hello,

I have few questions regarding Sure Start maternity grant and my baby citizenship.

Our Scenario:
-------------------------------
I am currently working on Tier 2 visa. I am here for 5 years now on working visa and now going to apply for ILR next month. My wife has Tier 2 dependent visa expiring in 29-04-2019. She then apply again for Tier 2 dependent for extension in order to apply for ILR at the end of next year.

Question. 1:
-------------------------------
My wife is pregnant and we are having our first baby in Oct-2018. Can she apply for Sure start maternity grant? She is unemployed too. Currently, she doesn't have an access to public funds as said on her Tier 2 dependent visa.

Question. 2:
-------------------------------
After getting my ILR next month, is my baby automatically become a British citizen or I need passport for my baby of the country I belong?

Thank you in advance for your reply and time.

1. Yes, sure start is fine. She must NOT claim child benefit in her name. You can claim if you have ILR.

2. If baby is born AFTER you get ILR and born IN the UK, then yes, baby will be British. If baby is born abroad, then no baby will not be British.
