Can I claim housing benefit?

Post by InaAC23 » Mon Mar 09, 2020 9:25 pm

Hi, my husband is on 'leave to enter' currently and we will be extending his visa in the following months. I am a British citizen (unemployed currently) and we're expecting a child. I was wondering whether we can privately rent and claim housing benefit just for myself and baby as we are both British. Will it affect my husband's visa and extension?

Housing Benefit has ended, unless the person (or both of the claimants in a joint claim) are of state pension age.
Universal Credit replaces 5 low income benefits, of which Housing Benefit was one. You can read about Universal Credit and the requirements expected from a claimant https://www.gov.uk/universal-credit

Until you have a child, you wil only be allowed the one bedroom rate of of Local Housing Allowance as you cannot claim extra for your husaband. If you (the person who is allowed to claim benefits) are under age 35, you are limited to the shared accommodation rate of Local Housing Allowance.
Your husband's salary will be deducted from your claim and you can not claim extra benefits for him.

On the reverse of your husband’s BRP under remarks is it stated no public funds? On what basis was your husband granted leave?
