Switching Employers Under T2G after Visa expiry: Pls help.

Post by Macpro » Thu Nov 21, 2013 2:02 pm

Hello,

I am currently on T2G visa and my current job contract finishes in next couple weeks. I have Job offer from another employer, however it is currently in the RLMT process and will be finished by third week of december at which point I get the COS.

My visa Expires on Dec 6th, but I will only get the COS by Dec 20th the latest. Question I have is can I still apply for my extension for same day process sometime before January ? As far as I read in policy guidance(para 17) it looks like with T2G I can apply for switch as long as it does not exceed 28 days from previous expiry date ? Is this valid assumption or do I have to go back and apply from my home country ?

Can someone please kindly answer and share your thoughts ?

Thanks

Hello,

I was going through the Tier 2 Guidance again and may be I was wrong in assuming 28 days of grace period as it seems to apply only if its ICT & ICT established staff and not Tier 2 general.

http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

Just underneath para 17, it shows it only applies to categories indexed as "1" and not Tier 2. Am I missing something here ?

Please would someone please confirm that I will still be eligible to apply for switch as long as it does not exceed 28 days or not please ?

Any help on this is highly appreciated.
