Tier-2 Extn delayed - HELP (going for SAR)

Post by abhisheks9 » Sat Jan 25, 2014 2:09 pm

Hi all
I have friend employed with reputed company, brought here through Tier-2, 3 yrs back.
On October he and his family applied for visa, for which there still no answer.

There is a complication though in Criminality section, which is: assault charge , sentence -admonition, not Guilty.
This was domestic issue now resolved/closed, and no longer a problem in family.

My friend is blamed at work for delay in response, and through solicitor being suggested to request for Requests for personal data through SAR (Subject access request).

My queries:
1) is there 6 months timeline by which UKBA has have to answer?
2) will SAR request help?
3) can application be withdrawn and applied at PEO on same-day?

Please suggest what best thing to do, as this is creating a difficulty with company/HR.

Thanks everyone for any kind of help

if your friend made a valid T2 extension application in October before his leave expired then he is covered by section 3C and his T2 leave is automatically extended until UKBA make a decision on his application.

If the employer wants to check your friend's right to work while his application is pending they can do so via the employer checking service:

it may throw some light on the reasons for the delay so no harm doing one, it only costs£10 but could take some time to get it back (check if there are current timelines on the forum)

Hi again Manci
you been very helpful, i have another question.
what if my friend request for application withdrawal and return of documents? what will be his status?
he anyway planning to move out of UK to another location, in around mid of this year.
He went for extension just for few more months sake. Now trying to find out how soon visa can be granted for next location, and if can get earliest, may be best thing is to withdraw and exit?
