I've got rejected a Tier -2 visa in accordance with Appendix-J minimum salary threshold. My employer provided me with a SOC 2134 according to which minimum salary threshold is 29000 for 39 hrs a week whereas my actual salary is 28000 pa for 40 hrs a week. Now my employer is not prepared to increase the salary but they're ready to assign me a new CoS with different SOC i.e. 2133 which has minimum salary threshold of 25000 pa for 39 hrs a week.
My question is, the above will solve the problem but won't UKBA will think that something doesn't seems right here as change of SOC code within a month seems inappropriate. In actual my employer didn't knew about SOC as they're also sponsoring someone for the first time.
Can you please guide me on this. Looking forward to your reply.
