ILR Eligibilty - Tier 2 ICT Case

Hello,

Please find below the category of visa I moved into UK and currently in

Landed in UK - 23rd March 2011
Visa Type when landed - Tier 2 (ICT) Established Staff (Valid from 01/03/ 2011 to 31/03/2014)

At end if March 2014, my employer applied for visa extension and

Visa Extension - Tier 2 (ICT) Long Term Leave to Remain (Valid till 01/04/2016)

Here are my questions:

1. Am I eligible for ILR 5 years from March 2011 (i.e. March 2016)
2. Should i not be eligible for point 1, can my employer extend my visa beyond 5 years?
3. Can i switch to Tier 2 General and be eligible for ILR after 5 years?

1. NO, as you don't have ICT leave under the rules before 6 april 2010. But you would be eligible for 10 years Long Residence ILR if UKBA rules won't change in the future.
2. YES, provided you get CoS from your employer for extensions.
3. YES, can switch into T2 G, but will reset your ILR clock with T2G. Also you would only get max. of 3 years T2G visa as per the new rules from 06 april 2014, since you've entered in 2011 as T2 migrant (max. possible allowed time with T2 migrant visa is 6 years). In that case, you won't be eligible for ILR with only 3 years stay in T2G visa.
