Hello All,

Situation: I'm being harassed by Capita, threatening me with deportation, more than a year after I already left the UK on a valid visa. The 'case' is being dragged out and I urgently need to visit the UK.

Background: I was made redundant from my Tier 2 (General) sponsored job and my last date of employment was March 2013, with a couple of years of leave remaining on my BRP. Unable to find a new sponsor and being under too much stress at the time to consider other options, I decided that the best course of action was to maintain a clean immigration record and so I left the country voluntarily 60 days after redundancy in order to be certain that I didn't breach any curtailment period (even though I hadn't received a letter- I figured it would be best to leave whilst I was certain that my leave was still valid). Before leaving I had received religious baptism which had been scheduled for a long time and so changed my name. I managed to update my passport before leaving but there wasn't enough time left to update my BRP and had I sent my documents in for an update whilst a curtailment was issued, I would have risked facing enforcement action and deported.

I wrote to the UKBA informing them of my change in personal details and date of departure, supplying all necessary information and all my documents were checked at the port of exit by Border Agency staff. Of course due to the cooling off period, I wasn't able to apply for a new Tier 2 visa to avoid a break in continuous residency- a figurative kick in the behind for me, being very near the 10 year route finish line, but that is a separate issue.

A year later- I received an e-mail from Capita, claiming to represent the UKBA, asking me to make "immediate arrangements to leave the UK" and threatening me with "enforcement action" and that failure to comply could affect my "right to return to the UK". Apparently a 'case' had been issued against me and I had been bundled together with the various illegal immigrants and criminals that the UKBA has lost track of. In spite of supplying them with all the necessary documentary evidence to prove that I changed my name and that I have left the country- they have been "processing" my case for months. In the mean time I have lost the opportunity to return to the UK under a student visa for this academic year and at this point in time, desperately need to apply for a temporary visa to visit a critically ill family member. They refuse to answer my questions regarding the process and time-scales and have ignored my requests to allow me to have this 'verification' done in-person at a local British consulate.

Has anyone had any experience with Capita? Do they have any published guidance or regulations that can shed some light on their 'verification' process- on the lines of the guidance issued to UKBA caseworkers? if I apply for a visitor's visa, supplying all necessary documentary evidence, will this 'case' cause any hindrance to the application?

Does anyone have any information on how Capita deals with cases?
