Tier 2 (General) - Dependent

Post by GlenEagle » Fri Oct 03, 2014 4:23 pm

Hi,

I am on a Tier 2 (General) Migrant residence permit which expires in October 2015. That said my 4 years and 10 months have been completed last month which means I am eligible to apply for an ILR. My wife is on a Tier 2 dependent spousal visa which also expires next year in October 2015. She has only been in the UK for 1 year and 6 months. My questions are:

1. Once I obtain my ILR, can my wife apply for an FLR(M) soon after although she still has almost a year left on her Tier 2 dependent visa to expire?

2. As it stands the only restriction stated on her visa is 'No recourse to public funds'. Does that mean she can train as a doctor and hence apply for training positions with the NHS and doesn't have to satisfy Resident Labour Market Test?

3. If the answer is 'Yes' for the second question above, if she keeps herself on Tier 2 dependent visa and come October 2015 applies for an extension in the same category (i.e. wants to extend her tier 2 dependent visa and not switch to FLR(M)) what is the possibility of the 'no training as a doctor or dentist' restriction being put on her tier 2 dependent extension visa?

4. Is my understanding correct in assuming that as an ILR dependent i.e. being on FLR(M) visa, there is no work restriction what so ever? The only restriction is restriction to public funds which is not at issue at all for us.

5. If she does decide to change to FLR(M) now to avoid any work restriction issues (confusions) with the NHS, will her time counter be reset to 0? Would she then need to spend 5 years on FLR(M) status to be time eligible for an ILR? Or will she keep the time she has already spent on Tier 2 dependent visa in the UK?

Would appreciate a prompt response from an informed person.

Thanks.
