Tier 2 (ICT) Query for a friend

Post by ankjain » Sun Oct 12, 2014 9:42 am

Hi
Need help for one of my friend. Please advice or suggest a solicitor who can help.

Thanks in advance.

His query:
I moved to UK with my wife and son in May-2014 through an MNC. My first Visa was Tier 2 ICT Established Staff From 16-Aug-2010. I again applied for Entry Clearance from India and received Tier 2 ICT Long Term Staff Migrant From 23-Aug-2012 till 23-Sep-2015.

I have following Questions:
1) After my current Visa Expire in 23-Sep-2015, For how long can I apply for extension and can live in UK?
2) When would I be eligible for ILR (if at all) ?
3) After the maximum duration stay according to my Visa category is completed then is there any way to avoid '12 month cooling off' before applying for fresh Entry Clearance?
4) If my wife (who is currently on Tier 2 ICT Dependent Visa and no previous Visa) gets a job with Tier 2 General Sponsorship, can I move to Tier 2 General Dependent?
4 a) If I move to Tier 2 General Dependent, I would not be restricted to my employer and can switch jobs?
4 a) If I spend 12 months on Tier 2 General Dependent, then I can apply for my own Tier 2 General if I get restricted CoS with an employer? To be clear, 12 month period spent on Tier 2 General Dependent is considered as cooling off period?

Let me know any further information required to resolve my queries.
