Tier 2 ICT to ILR

Post by VaishnaviR » Sat Oct 25, 2014 10:58 pm

Hi Friends,

I have applied Initial Tier-2 ICT Long term visa before 6th April 2010
(i.e. it was granted before 6th April 2010 rules) and it was extended twice
(i.e. one in April-2012 and second in April-2014). I was outside UK from 10th Sept-2013 to 6th April-2014.

Could you please clarify when I will be eligible to apply ILR as I will be completing 5 years on April-2015?

OR Do have the eligibility to switch into Tier-2 General, if yes, does it require any workpermit sponsor(COS)?

As per my understanding on UKBA policy, I can apply by April-2015 by showing some proof of evidence from my employer that only for official reasons I traveled back to India and stayed there more than 180 days( In my case 204 days) OR If I can submit the evidence that illness of my close relative that I traveled back to India then UKBA may consider to grant ILR despite of my 204 days stay outside UK. Could you pls someone clarify whether I understand this correctly?

Also, I afraid my employer may not help me to provide the letter/evidence to justify my 204 days stay. In this case any other way to process the ILR? One more important point that I noticed from UKBA policy even If I dont have this 180 days outside UK stay issue if I apply for ILR my work permit sponsor should mention that they need me to stay in UK for work reasons. I dont understand that why my employer involvement is required to apply for ILR since ILR will qualify me to work for any employer? ( i.e. After I change the status from Tier 2 ICT to ILR - Does it mean I should only work for my workpermit sponsor unless I switch into another workpermit sponsor? Is workpermit sponsor is required after getting ILR? OR Like Tier 1 General I can work for any employer without workpermit sponsor dependency?) Could someone pls clarify this?

Many thanks for your help and your valuable time.

Hi Friends,

Well, someone could you pls suggest good ILR consultant contact details to get clarification?

Thanks,
