Hi Guys/manci,

I cam in Uk in Mar 2011 as an ICT. I know that i cannot apply for ILR and will have have to start over again with T2G.

I have gone through the new Nov 6th circular and it allows me to start over again and count 5 years with new Visa, this was impossible before 5th Nov.

Now my question is, the below lines from the circular. I have an offer from an Umbrella company, ready to sponsor me T2G. One of my friend with same Umbrella company and visa, was recruited as a contractor by an Agency. Does the below mean, it will now be illegal for an Agency to find a contract job for us? Should I be going ahead with this offer, as I know it will be close to impossible to find a client directly for contracting after excluding an agency. Please advise.

An applicant must not be:
 An agency worker, hired to a third party to fill a position with them, whether temporary or permanent, regardless of any contract between the sponsor and any employment agency or employment business.
 Contracted to undertake an ongoing routine role or to provide an ongoing routine service for the third party, regardless of the length of any contract between the sponsor and another party.

Umbrella companies to exist and Tier 2 general visas are sponsored to these organisations. HOWEVER, UKVI take the view that this arrangement is not in the spirit or letter of the purpose of Tier 2 general visas. These companies are being found out and removed from the sponsor's list. That would leave you in a real pickle if you were being sponsored by one of these companies, they were found out and removed from the list. You would then need another sponsor.

My advice: this is a bad idea.
