Tier 2 iCT to Tier2 General

Post by hai » Sun Dec 28, 2014 12:20 am

Dear manci,

Appreciate your patience and helping hand to aspirants for resoloving their quereis, To be honest, hattsoff to you.
i have a small query, here are the Background;

1) Work permit issued for Intra-company transfer - valid from 12/03/2007 to 12/03/2009

First entry in UK: 26/03/2007
Left UK: 01/06/2007
• 2nd entry 25/03/2008
• Left UK: 15/02/2009

I had a break of 1.5 year (18 months) from 15/02/09 to 16/8/2010 (no continuity of visa)
i.e. worked for same employer at offshore location

2) Applied ICT - Applied from India and valid from 16/08/2010 till 08/03/2015 (staying continuously in over 4 years by doing in country extensions at UK).
Entry – 23/09/2010
Exit - continuing

Staying over 4 years in UK by doing in-country extension for same employer.

I understand there is 10 year long route.

My queries:

1) Is there a way to qualify for ILR under 5 year employment if I apply on april 2015
2) What is the best solution?
3) current chances of extension my tier2 visa from current sponsor is 50 50. Can I jump to tier2 general on march 2015 from tier 2 ICT, for ILR do I need to wait for further 5 years ie 2021 for ILR?
4) if I taken T2G on march 2015, only it valid 6 years(2 extensions) ie till 2021, after that do I need to go back and serve 1 year cooling period to come back again to UK?
5) My kid also accompanying with me 16/08/2010 till date marc 2015…is he eligible for ilr , or
Is there any 7 years criteria for kids eg : he will be eligible only in 2017 if I take tier2 general in March 2015.
Many thanks,
Hai

Because you were absent for 18 months, this breaks continuity of any kind, so forget about the period spent in the UK before 2010. If you would like to become eligible for ILR, look at the long residence route or switch to Tier 2 general. Tier 2 general would be a 5 year route.
1) No.
2) See my advice above
3) Because you have leave granted before 6 April 2011, you can switch to Tier 2 General with a new sponsor at any time. Yes, that would start your clock for ILR.
4) After 5 years on Tier 2 general, you might be eligible for ILR (there are income requirements coming in starting 2016).
5) I cannot imagine why your child would be... he hasn't been here for 7 years.
