A stupid TICK box - maintenance (Tier 4 to 2 Refusal)

Post by Valuer2 » Thu Jan 15, 2015 5:48 pm

Hi all

Please help, I am currently on my 28 days grace period after the 2nd refusal from my 2nd application. Please advice me if there is a way to edit that COS now even though it may seems too late. As it stated in my 2nd application, I do not have a right to appeal, is there anything else I could do?

Just a brief explanation on my situated, I have applied my first application before my student visa expires, which was rejected as I applied under the wrong job title and did not provide my academic transcript (original copy). Hence I made another application, which was fine, except the COS assigned to me did not tick the box where it states it will sponsor or be responsible for my maintenance here in the UK. Which my company did meant to but has overlooked because we were too focus on the deadline and the documents needed to be provided. Because of this tick box, I am now require to return to Singapore and apply for another application.

A brief financial implication that was implied on me due to this visa applications. With the previous 2 applications which cost me £1,200 (which I am in debt now, not that it’s relevant) not including 2 bio-metric scans, the flight ticket for me to get back to Singapore which gives me a further burden of £500, with addition to the 3rd application of roughly £600 this will immediately put at £2,300 in debt. This has really stress me out and I hope your company will be able to do something.

My directors are willing to write a letter to officially state that they are willing to sponsor my maintenance and require me in the company due to several reasons. Other than that I have my pay slips which could prove that I am able to sustain my own maintenance in the UK with the salary I am receiving. Why wouldn't this be taken into consideration?

Any help or advice is much appreciated!

Yours faithfully

I'm sorry to hear about your refusals.

Unfortunately, the world is black and white for HO. It seems that your options are limited. Here is what I would do if I was your shoes.
  • Leave the UK ASAP so that no ban is imposed.
Ask the sponsor to carry out RMLT for the position and then issue you a new restricted CoS.
Request a printout of the CoS before issuance and verify the details are correct.
Check the sponsor is still on register online and re-apply for T2G with the new CoS with all the necessary documentations i.e university degree, photographs etc.

Sorry to hear that, the whole story sounds like a complete disaster.. Hope it will be ok sooner or later.

One thing that might be helpful to other people in your situation: your employer can't change your COS afterwards, but he can add notes to it any time (using that online system for issuing new certificates of sponsorship). And case workers usually consider that notes, because they were added to COS exactly for such situations (when people were not careful enough while issuing them). So you could have asked your employer to write something like "Dear case worker, please note that this applicant's maintenance is guaranteed by the company, blah-blah-blah" - all that things from the letter you were about to provide. And describe the situation as detailed as possible.
It worked like a charm for me (I had some mistakes in my COS as well, but I noticed them before my first application and asked to add notes with explanations).

Once a COS becomes "used" the note field is deactivated.
So in this case the Sponsor can not add anything, plus the fact once refused the COS is invalidated.
