Tier 2 ICT Dependent to Tier 2 General

Post by ankjain » Sun Jan 25, 2015 12:31 pm

Hi
My spouse is currently on Tier 2 ICT Dependent from May 2014. She joined a job in Jan 2015 and her firm has agreed to get her Tier 2 General visa. We want to know how we should proceed next and timelines:
* firm takes RLMT. For this they have to advertise the job etc. etc. ? how long does it take? COnfusion is, my wife is already hired so what is the need of RLMT or what RLMT proves now? Can the already taken interviews be considered?
* firm issues CoS
* she applies for tier 2 general from home country i.e. India. If anyone has any experience, how long does it take ?

thanks in advance

Your wife's current employment as a PBS dependant is irrelevant for becoming a T2 sponsored worker. For the latter she will need a NQF level 6 job with appropriate salary, for the former she only needs to be paid the NMW.

RLMT and a restricted CoS will be needed before she can apply from the home country. RLMT takes min. 28 days and restricted CoSs are allocated on a monthly cycle. Visa processing times vary from country to country and are published online,

Hi Experts,

1) I came to UK on Tier 2 ICT (long term) in April 2014 with visa till April 2016.
2) My family came to UK in Sept 2014 as dependents
3) Recently my wife got job in IT and her employer is ready to sponser Tier 2 General.

If my wife gets Tier 2 General for 3 years and i become her dependent

2 years of my ICT stay + 3 years of dependent stay (total 5 years )- will i be eligible for ILR?

two reasons:
your T2 ICT leave doesn't include a period before 5 April 2010
PBS dependant leave is not T2 leave, i.e. it cannot be aggregated with T2 leave on the 5 year route

see immigration rule 245GF:
