RLMT Questions for Manci - Urgent

Post by hassanh » Thu Jun 11, 2015 1:25 pm

HI Manci and Other Gurus,

Would highly appreciate if you answers my below queries.

My company wants to run RLMT for a post so that I can have an equal chance to apply for that post. Is the RLMT be successful if they do the below:

Advertise the job simultaneously in Universal Job Match (online version of job centre plus) and on jobserve.co.uk.
After 28 days short list candidates and schedule interviews. If I am successful in interview as well and if they do not find any other suitable settled person, then they can offer me a place? Will UKVI have any issues if they finalise the interview processes in very short time after advertisement has been taken off like within three to four days? Is it ok to have a COS issues just after few days the job advertisement is taken off?

Is it required to mention weekly working hours in the advertisement if the job is for 35 hours a week?

What details they should provide regarding RLMT in COS?

They job code will be 2133. The experienced rate salary for this code is 40,300 [Salary Source: Incomes Data Services in 2014, uplifted based on national changes in earnings}. What salary would they should offer/advertise to prorate this to 40 hours a week?

Apologise, as I have asked too many questions but need answers for these as soon as possible so that I can be relieved there is nothing missing in RLMT process.

Thanks,
Hassan

Hi Manci,

Please, reply to my above post. Would highly appreciate that. My employer is posting advertisement from Monday and I will not be able to ask them to change anything once the job advert go online. This is real urgent for me?

Regards,
Hassan

Is it required to mention weekly working hours in the advertisement if the job is for 35 hours a week? Yes because this affects the advertised salary for SOC Codes. if actually goes in your favour. If you earn same amount in 35 which someone earns in 40 or 37.5 your salary will be considered as more from them.

I believe Salary are already calculated on 39 or 40 hours you can check the PDF guide and it will tell you exactly how many hours it is calculated as.

Apologise, as I have asked too many questions but need answers for these as soon as possible so that I can be relieved there is nothing missing in RLMT process.

Hi Bholo,

Your reply is much appreciated although I am still confused.

In which rules it says wait 28 or 30 days before applying for visa after the online job advert has taken off?

Well, they will only advertise the salary after prorating it to 35 hours. I could not find in document what hours Salary Source: Incomes Data Services in 2014, uplifted based on national changes in earnings} is based on?

My questions are not answered completely yet. Please, everyone can share your thoughts on my post?

Thanks,
Hassan

https://www.gov.uk/uk-visa-sponsorship- ... uitability

Read last paragraph

How long to advertise the job for

The advert must run in the UK for 28 days in most cases, either continuously or in 2 stages.

If you advertise in 2 stages, your advert still needs to run for a total of 28 days and neither stage can be less than 7 days.

You must be able to show that you didn’t find a suitable worker.

You can read the guidance on the shortage occupation list and resident labour market test.

Well, they will only advertise the salary after prorating it to 35 hours. I could not find in document what hours Salary Source: Incomes Data Services in 2014, uplifted based on national changes in earnings} is based on?

https://www.gov.uk/government/uploads/s ... _final.pdf

With every salary there is a source mentioned.

If you go on page 3-4 of this document please read this
The rates stated are per year and are based on the following weekly hours:
4
(i) Where the source is the Annual Survey of Hours and Earnings, a 39
-
hour week;
(ii) Where the source is NHS Agenda for Change or
the Royal Institute of British
Architects, a 37.5
-
hour week;
(iii) Where the source is teachers' national pay scales, on the definition of a full
-
time teacher as used when determining those pay scales;
(iv)
w
here the source is the National Grid submi
ssion to the Migration Advisory
Committee, a 37
-
hour week;
(v) In all other cases, a 40
-
hour week.

Let me know if this answers your question

Hi Bholo,

Thank you for your reply once again. I know the job should be advertise for 28 days but I want to know that after these 28 days how long the employer should wait to issue the COS? Also, I want to know that jobserve.co.uk is acceptable website by UKVI for RLMT?

Thanks,
Hassan

Hi Manci and other respected Gurus,

Can someone at least confirm if jobserve.co.uk is accepted by UKVI along with Universal Job Match for RLMT purpose? And also for how long the employer should wait before assigning the COS after 28 days of job advertisement.

Would be very grateful to you all.

Thanks,
Hassan
