Tier2 Application without COS Letter

I am currently on PSW Visa which will end within 15 Days. Recently, I got job offer from company which has filed tier 2 sponsorship license applications to Home office and is under consideration. It will take 4 to 8 weeks.As soon as they will receive sponsorship license they will apply COS letter to HO. My prospective company advised me to send Tier 2 Application without COS Letter. My company also advised me to request HO to hold my tier-2 application until COS letter sorted.

My Question:
1) Is there any provision that I can make tier 2 application without COS letter?
2) What are the immigration guidelines regarding request HO to holding my Tier 2 Application?
If My Company’s tier 2 sponsorship license application unsuccessful or not provide me Cos Letter. Can I make fresh application?

hi, Its utterly waste of money if you apply visa without COS letter, provided your sponsor do not have licence at the moment, so there is lot of uncertainty. I advise you to talk to a solicitor before you do it, and do not waste your chances of getting visanif properly filed.You may ruin it by applying without meaningful documents.Hope it makes sense, in my view go for a FLR application, and then VARY your application to Tier 2 once you have a valid COS.

sorry i saw this late. From my understanding, your sponsor can request a speedy service from the home office if they declare to home office that they have a person for the job and this will require your employer to provide ur details of ur current visa to home office to speed up. I know a guy who did it this way 2 years ago and they got the decision in 2 weeks as he was running our of time.

At present i m still waiting for my prospective employer to get his license , initially applied in July 15, then home office came back and said they need the original rent agreement(on paper) on august 16th, as the employer had sent an copy by email.
