Hi Team,

My query may have already been answered in your forms but I am still not very clear can you please provide your inputs on below query.

Query 1)
What are the rules for issuing (unrestricted COS ) and (restricted COS ) ?

Query2) If Tier 2 General PBS Dependent applies from INIDA to switch to TIER 2 General is there fast track process via which we can get the visa processing and document handover done within 1 weeks time ?

Query 3)

My wife Visa type is (Tier 2 General PBS Dependent ) and she is currently working in UK on a permanent role and her company is ready to provide her Sponsorship as I understand if she gets (restricted COS) she has to go back to INDIA and apply for VISA for TIER2 General which will take apprxo 2 to 4 week provided we have all the correct documentation but if she gets (unrestricted COS ) she can switch form Tier2 PBS dependent to Tier 2 General with in UK

Can you please confirm the above understating is correct ?

Query 4) Is there any better way you can suggest ? happy to take any package for consulting if we have surety that it will be done else money will be refunded

Why does she want to change categories?
When are you eligible for ILR?
When did she apply to be your dependant and when did she enter the UK?

If she changes from dependant to Tier 2 (General), then her qualifying period for ILR under Tier 2 (General) will be reset.

Currently I have T2G for NOV 2017 but my project may get over in JULY 2016. That is the reason why we are changing hopefully she will get 5 years visa.

She has not applied yet we have only started thinking abut this route.

She came in Aug 2014 and Started working in Feb 2015.

1. RLMT is mandatory for both restricted and unrestricted COS, unless under shortage occupation.
Restricted(outside UK) has an annual cap and monthly allocation limit.

3. Changing to a Primary applicant will need a restricted COS to be applied from home country.
