Switch - Tier1 General to Tier 2 ICT

Hi,

I came to UK in May 2010 via Tier2 ICT & then switched to Tier 1 General in Aug 2011.
In Aug 2013 my Tier 1 got expired as I could not apply for extension because I was not meeting salary requirements. Within 3 weeks of expiry I had switched back to Tier 2 ICT long term again in Sep 2013. I understand that under new rule I can't get ILR because ILR is not allowed for Tier 2 ICT long term visa holder.

Question - Since the gap between my new Tier2 ICT & Tier 1 general is less than 20 days. Can I leverage my old Tier 1 visa for ILR purpose i.e. can I apply for ILR in AUG 2016 considering start date of my Tier 1 visa.

Kindly Advise as I could not fine any similar case in forum of switching from Tier 1 General to Tier 2 ICT without a gap.
