Tier 2 General - Change of sponsor - URGENT HELP REQUIRED

Post by ukfamily » Fri Nov 06, 2015 10:47 pm

Dear Manci,

I am on a Tier 2 General Visa which is valid till Apr 2016. I resigned from my current job by end of October as I got an offer from another employer sponsor. However the RLMT will be completed only by Dec 1st week and the sponsor will issue the CoS only during the second week of Dec'15. I am planning to appear for a premium interview for visa processing in the 2nd or 3rd week of Dec'15 based on availability.

My understanding was that after the current sponsor intimates UKBA about my resignation, I will get 60 days grace period before UKBA curtails my leave. However in the below link I came across a paragraph which is quite alarming.

https://www.gov.uk/government/uploads/s ... _v15_0.pdf

Tier 2 or 5
If you curtail a Tier 2 or 5 migrant’s leave because the employment, volunteering, training or
job shadowing will end earlier than originally expected, you must curtail their leave to the
new end date plus any wrap-up period that was originally allowed. For example, if the
migrant was originally granted leave until than end date of employment plus 14 days, you
must curtail leave to expire 14 days after the new end date of employment.

Please could you help with below queries?
1. Will my leave be curtailed to 14-Nov-15 as my current employer already informed UKBA that I resigned by 31-Oct-15?
2. Is it 14 days or 60 days for curtailment?
3. When does curtailment grace period start? Is it from end of employment or from the date, UKBA takes the decision to curtail?
4. Will I or representative be informed of curtailment through post?
5. I am worried that when I go for change of sponsor in Dec'15, my leave to remain will show as curtailed already in case of 14 days. Even as a worst case scenario, can it happen based on my above circumstances?

Thanks in advance.
