Tier 2 (General) to ILR Salary information

Post by kmm26 » Tue Apr 05, 2016 5:28 pm

Hello

I am currently on Tier 2 (General) permit and due for renewal later this year (2016).

I will complete 5 years next October (2017), when I will be applying for ILR. As my sponsor will cover me for 18 months from oct 16, I shall have 6 extra months to apply for my ILR.

My current salary is well above the threshold for my sector and I have not had issues with renewals.

With the introduction of new rules, I will need a £35k salary to apply for IRL which is not an issue.

But does the £35k salary need to be paid to me on my final CoS which I apply for in Oct 16 or does it need to be for when I apply for my IRL in Oct 2017?

I have been in the UK, since 2006 as a Student and complete 10 years this September. Would it be beneficial to apply for a Long Residency?
- PS - As I used to travel back home a fair bit, I think I am an Illegible for this route!

Thank You for your help.

At the time of ILR.

The visa and ILR fees have increased from last month, so no benefit on the fee front; also, the new 35k threshold rules will come into effect from tomorrow, so no escape from it either. If you meet the requirements for ILR under 10 years long residency (not outside the UK for x number of days, etc.), the advantage would be that if it gets rejected for some reason, then you have plenty of time to sort out your next steps, still have Tier 2 visa to fall back until at least 2017 and could reapply for ILR again with more robust application/documentation (I guess).

You mentioned you will have 6 months on Tier 2 as well to sort out ILR, so it's good that you have enough time, so weigh pros and cons (wait for others feedback on this forum) of ILR via Tier and long residency options and go for the better option.
My advice is based on personal research/experience, so pls check relevant UKVI sources.
