Hello
I am currently employed and my employer sponsors my Tier 2 General visa. I applied for a job at a start up and cleared it. Now, the new employer has no idea about visas and has asked me to help
1) Does the new employer have to apply for a CoS or can it be transfered because the job profile is the same ?
2) The job was on the job portal for 30 days. I understand there is a requirement to keep the job on the portal for N number of days before hiring immigrants like me. Does anyone have an idea about it ?
3) Will the change of job reset the number of days required to get ILR status ?
Regards
Pranam
First and foremost, make sure you don't resign from your current job until you have a new BRP to work for the new company.
The new company will need to register to become tier 2 sponsor. The process could take several months as they will be required to submit documents to support the application. And they could be visited by UKVI before they are finally approved to sponsor tier 2 visa.
Then they will request for CoS and assign the CoS to you.
The will need to carry out RLMT before assigning the CoS to you. You also need to be earning the appropriate salary.
You submit you application and it will treated using all the necessary criteria
The process could take from 1 month to 6 months.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
